Dr Jenny Buchan

Jenny began her legal career in New Zealand before moving to Australia, where she advised on business sales and purchases, leasing and franchise matters. She was the first female to be accredited as a small business specialist by the Law Institute of Victoria. Jenny has researched, written and spoken extensively on franchise law including due diligence, dispute resolution, marketing funds and good faith obligations. She has supervised research into franchise law in Australia, France and the USA, and made submissions to parliamentary inquiries into franchising and consumer law. She has also examined doctoral dissertations on franchise law in Sweden and the Netherlands. Jenny was appointed Professor Emeritus by UNSW in 2020 and currently teaches Principles of Private Law at the UNSW Law School. Jenny's expertise led to her appointment as a panel member of the Australian Competition and Consumer Commission's Franchising Consultative Committee (2010-2015) and its successor, the Small Business and Franchising Consultative Committee (2016-2018).

UNSW Emeritus Professor Dr Jenny Buchan, Senior Advisor at H & H Lawyers, has completed a comprehensive review of the operation of the Australian Consumer Law and the Franchising Code of Conduct in Australia's new car market commissioned by the Australian Automotive Dealer Association. The Root and Branch Review of the Australian Consumer Law (ACL) and the Franchising Code of Conduct (Code) as they apply to Buyers of New Cars (Consumers), Manufacturers (Franchisor/OEMs) and New Car Dealers (Franchisees), examines how Australia's consumer protection and franchising laws operate across the relationships between consumers, car manufacturers and franchised dealers. Commissioned by the Australian Automotive Dealer Association (AADA), the Issues Paper constitutes Stage 1 of a broader project examining the legal and practical challenges experienced in the new car sector.
