Jayne Nah
Jayne specialises in Succession Law and Estate Planning. Prior to joining H & H Lawyers, Jayne studied accounting and audited manufacturing companies and superannuation funds. Later, as a senior accountant at Ernst & Young, she was part of a specialist business team that looked after Korean international companies in Australia such as Samsung, Hyundai, Korean Air and Kumho. Subsequently, Jayne moved to commercial accounting and worked for Prudential, then relocated to Korea where she worked for EMC Korea. After moving back to Australia, Jayne made a career change to law. Jayne commenced her legal career with a specialist boutique law firm specialising in Estate Planning and Succession Law in 2014 and was admitted as a lawyer in 2015. Jayne has experience in complex Probate and Letters of Administration applications and in Estate Planning, including asset protection strategies. Jayne understands that all families, especially blended families, are different and have their own unique relationships and circumstances, which must be taken into account to achieve successful Succession and Estate Planning.

Worked as an auditor with Ernst & Young, auditing international companies and superannuation funds. Also assisted tax advice team in advising Korean subsidiary companies in Australia on Fringe Benefit Tax and Corporate Tax issues.
Maintained company accounts and prepared financial statements as a financial accountant and forecasted and budgeted for sales and commission accounts as a management accountant in a multinational IT company.
Experienced in Complex Probate and Letter of Administration Applications.
Experienced in drafting complex wills and providing advice on estate planning for complex and blended families.
Reviewed and amended family trust deeds to be in line with estate planning.
Advised clients on finalising deceased estate and experienced in preparing Deed of Family Agreements.
Assisted in advising and preparing for Family Provision proceedings.
Prepared and successfully received a favourable private ruling from the Commissioner of Taxation in relation to re-settlement issues involving family trusts.

Peter Brock and the three Wills
Most Australians who are car enthusiasts will know Peter Geoffrey Brock (“Peter”), also known as the King of the Mountain, was one of Australia’s most successful motor racing drivers. His life was cut short on 8 September 2006 when his car skidded off the road during a competition rally in Western Australia. Peter drafted three Wills during his life. His first Will was properly drafted by his solicitor and executed in 1984 (“the 1984 Will”).

Death of K-pop star, Goo Hara, reminds us the importance of having a valid Will
Anyone who is familiar with K-Pop news would have heard about the death of K-Pop singer Goo Hara, former member of Korean girl group Kara. Following her death, the sad childhood of the singer came into light due to a legal claim brought forward by the singer’s mother under the Korean Inheritance law. It was reported that Goo Hara’s mum abandoned her and her older brother when Goo Hara was only eight years old and never cared for them or contacted them since the abandonment. It was reported that Goo Hara’s mother subsequently gave up her legal parental and custodial rights in relation to Goo Hara and her brother in 2006.

Superannuation and Estate Planning
Since the introduction of Superannuation Guarantee in 1991, most Australians will have some form of superannuation as part of their asset. For most, by the time they approach their retirement age, superannuation will usually be their biggest asset besides their residential property. The younger generation, as they have just commenced their careers, would not have had much opportunity to accumulate significant superannuation saving or assets in their own names.
