Australia's rules on foreign investment are complex. In addition to its responsibility for examining foreign investment proposals and making recommendations to the Federal Government, the Foreign Investment Review Board (FIRB) has ever-increasing powers to "call in" and review transactions it considers posing a concern to Australian security. Depending on the investment structure, the nature and origin of the investor, the transaction type and the industry sector, notification to FIRB may be mandatory or voluntary. Even where it is voluntary, seeking approval may still be advisable.
